On Thursday afternoon, NSW Health announced a temporary exemption to the donor limit would come into effect in mid to late October to allow those affected to continue their treatments.

"Recognising the significant emotional, physical and financial impacts the misinterpretation of [this law] would have on women and families, through no fault of their own, the NSW government is creating an exemption," a NSW Health spokesperson said.

The exemption will apply to those women who before October 1 either:

- Had an embryo (of the woman or the woman's spouse) held in storage by a registered provider, or
- Reserved a gamete (eggs or sperm) that was held in storage by a registered provider, or
- Reserved the use of a particular donor's gamete held outside of NSW and had commenced preliminary treatment with a registered provider after July 1, 2025 for the purposes of receiving treatment using that gamete.
